The ban on magic mushrooms (since december 2008) is not injust, we have heard a few minutes ago.
That was the verdict in the courtcase of the Dutch Smartshop Organization (VLOS.nl) against the Dutch State.
We are waiting for the details of the verdict and will discuss whether to go into appeal to the higher courts. |

We hereby present you an update of the case (proofread by our lawyers):
In November 2008 the Dutch Smartshop association (www.VLOS.nl) started legal proceedings in order to have the mushroom banning order by the Dutch government declared invalid because of a number of legal shortcomings. VLOS also claimed damages on behalf of its members. VLOS lost the case and appealed.

 We just came back from the Magic Mushroom appeal courtcase in Den Haag, this morning! The state's atturney really had a hard time; even his body language spoke for itself. Most of his arguments were wiped away! He kept using examples of 'shroom incidents' that had been already countered by our scientific data; and the the judge knows so. We hope the judge will have the courage to block the ministery's illegal ban on shooms!

 The urgent appeal courtcase of the National Smartshop Association (www.vlos.nl) against the government to stop the ban on shrooms will take place at 10:15 AM on the 5th of March 2009.  January the 13th the National Smartshop Association (VLOS.nl) went to court to demand an emergency appeal against the ban on shrooms. The shroom industry has been slaughtered on lies and unscientific grounds. On January the 18th the court agreed that our case is important and will speed up our appeal. |

 DUTCH SMARTSHOP ASSOCIATION (VERENIGING LANDELIJK OVERLEG SMARTSHOPS, www.vlos.nl) WILL CONTINUE LEGAL ACTION AGAINST THE BAN ON MAGIC MUSHROOMS EXPERTS STILL STATE MUSHROOMS ARE NOT DANGEROUS FOR INDVIDUAL, NOR PUBLIC HEALTH IN GENERAL, AND THAT FURTHER REGULATIONS WOULD GIVE THE BEST RESULTS
The Association condemns the decision of the Government since both Ministers of Justice and of Public Health refuse to listen to the stream of warnings from the experts, scientists and from the Association.

 Verdict 1st Courtcase: Smartshops (VLOS) vs the State of the Netherlands.Facility judge Court of law The Hague rejects Mushroom claims.
We will go into appeal at a higher court !
Contents indication: Magic mushroom injunction. The claims of the National Smartshop Association (VLOS) and co are directed against the State as Legislator in the main issue. With her claims, she wants to render inoperative a general committing regulation. For establishing the claimed facilities or another facility with the same effect, it is necessary that the measure is in contradiction with the higher legislation or general principles of the law.

 VLOS.nl: Prohibition of magic mushrooms is good for nothing.
Next Tuesday a summary procedure of the Dutch Smartshop Association (VLOS) and a number of smartshop owners applies against the minister of Health, Welfare and Sports. The summary trial judge will attend to the request denouncing the prohibition of magic mushrooms.
